Welcome to TourGuide.DIY. These Terms of Service ("Terms") govern your use of the tourguide.diy website and our scavenger hunt services. By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Services

TourGuide.DIY provides AI-powered, self-guided scavenger hunt tours in cities across the United States. Our services include tour registration, route guidance, challenge completion tracking, leaderboard rankings, and related features accessible through our website and mobile-optimized platform.

2. Account Registration

To access certain features of our services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

3. Event Registration & Payment

When you register for a scavenger hunt event, you agree to the following:

• All registration fees are processed securely through Stripe and are non-refundable unless otherwise stated
• Early Bird pricing is available until the specified deadline and cannot be applied retroactively
• Team Bundle registrations cover up to 6 team members as specified at the time of purchase
• You must provide accurate team captain and team member information
• Registration confirmation will be sent to the email address provided

4. Pricing Tiers

We offer the following registration options:

• Early Bird — $20 per person (available until the early bird deadline)
• Standard — $25 per person
• Team Bundle — $100 per team of up to 6 people

Prices are subject to change. Any price changes will not affect registrations already completed.

5. Refund Policy

Refund requests must be submitted at least 14 days before the event date. Refunds will be processed to the original payment method within 5-10 business days. No refunds will be issued for cancellations made less than 14 days before the event, except in cases of event cancellation by TourGuide.DIY.

6. Event Participation

By participating in our scavenger hunt events, you agree to:

• Follow all local laws and regulations during the event
• Respect private property and public spaces along the route
• Behave in a safe and responsible manner at all times
• Not engage in any dangerous, illegal, or disruptive activities
• Follow the instructions and guidelines provided by event organizers
• Accept that outdoor activities carry inherent risks

7. Assumption of Risk & Liability Waiver

Participation in scavenger hunt events involves physical activity and outdoor exploration. By registering and participating, you acknowledge that you understand the risks involved and voluntarily assume all risks of injury, illness, or damage that may result from your participation. TourGuide.DIY, its officers, employees, and agents shall not be liable for any injuries, damages, or losses arising from your participation in any event.

8. Intellectual Property

All content on the TourGuide.DIY website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of TourGuide.DIY or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

9. User Content

By submitting content to our platform (including team names, photos, and challenge completions), you grant TourGuide.DIY a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with our services and marketing.

10. Prohibited Conduct

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity of our website or services
• Use automated means to access or scrape our website
• Cheat or manipulate leaderboard rankings
• Harass, threaten, or intimidate other participants

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties about the accuracy, reliability, or completeness of any content.

12. Limitation of Liability

To the fullest extent permitted by law, TourGuide.DIY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use our services.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Multnomah County, Oregon.
